These Terms of Service ("Terms") govern your use of Javier Rental Concierge ("Javier," "we," "us") and the website at javier.rent, including the interest list and waitlist signup. By using our site or joining the list, you agree to these Terms and our Privacy Policy.

1. What Javier is

Javier is an early-stage rental concierge product focused on New York City, starting with Manhattan. Features described on the site — including listing discovery, pricing insights, and application support — are on our roadmap and may not be available yet.

Joining the interest list does not guarantee access, a specific timeline, or any particular outcome in your apartment search.

2. Eligibility

You must be at least 18 years old and able to form a binding agreement to use this site and join the waitlist. You represent that the information you provide is accurate and that you are signing up for your own rental search (or with proper authority for someone you represent).

3. Waitlist and communications

By signing up, you agree that we may contact you by email, phone, or SMS about Javier updates, early access, and rental-search-related messages. You can opt out of marketing communications at any time. Message and data rates may apply for SMS.

We may remove or decline waitlist entries that appear fraudulent, abusive, or submitted in violation of these Terms.

4. No brokerage or legal advice

Javier is a technology product, not a licensed real estate broker, attorney, or financial advisor. Information on the site or in communications is for general purposes only and should not be relied on as legal, financial, or housing advice. Always verify listing details, tenant rights, and lease terms independently before signing anything.

5. Acceptable use

You agree not to:

• Submit false, misleading, or someone else's personal information without permission
• Attempt to disrupt, scrape, or reverse-engineer the site or our systems
• Use Javier for spam, harassment, or any unlawful purpose

6. Intellectual property

The Javier name, branding, site content, and software are owned by us or our licensors. You may not copy, modify, or reuse them without our written permission.

7. Disclaimers

The site and waitlist are provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose or availability of apartments that meet your criteria.

8. Limitation of liability

To the fullest extent permitted by law, Javier and its operators will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the site, waitlist, or any future product features — including lost rent, missed listings, or lease disputes. Our total liability for any claim related to the waitlist is limited to the amount you paid us (typically zero for free waitlist access).

9. Changes and termination

We may update these Terms or discontinue the waitlist at any time. Continued use after changes are posted means you accept the updated Terms. We may suspend or terminate access if you violate these Terms.

10. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes will be handled in courts located in New York County, New York, unless applicable law requires otherwise.
